Under the GDPR, if an organisation is established outside the EEA but is doing business within the EEA, then the organisation must appoint a Data Representative to be legally allowed to continue doing business within the EEA.
The Data Representative acts on the organisation’s behalf as a local point of contact for individuals and data protection authorities in the EEA. A Data Representative must also maintain a record of the processing activities, and be available to provide any information on all issues related to data processing to the data protection authorities, upon request.
